ABC's For Sale by Owner (FSBO) program

This program is the only one that gives a home owner 100% market coverage, BUT  THEY MUST FIND THEIR OWN BUYERS (20% of the market) and at the same time offer it through the MLS (80%+ of the market) and agree to pay the co-op  commission if a real estate broker finds a buyer first.  One of the advantages the MLS has over the FSBO is the FSBO has more power.  You regain the power when you are also in the MLS as the FSBO buyer you have feels less able to be firm as you may have more buyers waiting from the MLS.
If you do find your own buyer and the buyer gets an attorney, the $500 fee remains as attorneys generally make more work.

THERE WILL BE NO OUTSIDE AGREEMENTS BETWEEN YOU AND THE BUYER.  EVERY CHANGE, INCLUSION OR REPAIR MUST BE DOCUMENTED ON PARER AND PREPARED BY ABC REALTY OR THE ATTORNEY FOR THE BUYER.  Fraud  is a criminal offense with jail time while most real estate transaction problems are civil and no jail time.  AN OUTSIDE AGREEMENT IS OFTEN THE SIGN THAT FRAUD MAY HAVE BEEN COMMITTED.  Mortgages are based on down payment (buyers risk) and interest rates (risk cost expense), outside agreements make it seem like the buyers risk is less and maybe fraud.  DON'T DO IT!

  • Electronic Contracts (mandatory, email is required)
  • All paper work, all disclosures, all contracts, negotiating advice, market advice during negotiations, inspection, per-qualifying, loan, contract changes and closing
  •  Showing service with extended hours (for real estate brokers only, you will deal directly with setting showing for buyers you have developed).
 
WHAT OWNER IS RESPONSIBLE FOR:

  • HAVE voice mail or answering machine
  • HOLD OPEN HOUSES
  • USE ABC SIGNS
  • CREATE AND USE "FEATURE SIGNS"
  • KEEP HOME IN MARKETABLE CONDITIONS (comply with 4’Cs, clean, clutter, condition and competitive)
  • OWNER IS RESPONSIBLE for all activity at property, letting inspectors, repair people and appraisers in when they have an appointment

 
WHAT YOU CAN NOT DO:
  •    NEGOTIATE anything with another broker, they may represent the buyer
  •    ADVERTISE a different price or terms
  •     REFER to ABC in any advertising (you may use the MLS #)
  •     CHANGE any of ABC’s brochures or marketing material with the exception of a price change made by a felt tipped pen. 
  •     MAKE CHANGES to any contract dealing with this transaction
  •     ABC will prepare any and all documents required to amend or change contract
